FIGHTING FOR EMPLOYEES

Dedicated Legal Advocacy from a Former Company Insider & Litigator

Profile

Justin L. Clark, Esq.

I spent a decade representing employers—both at law firms and in-house—navigating the complexities of workplace disputes, compliance, and litigation. That experience gave me deep insights into how companies operate, how they respond to employee claims, and how to build strong cases to hold them accountable.

Now, I use my knowledge to stand up for employees who deserve better. Whether you’re facing discrimination, harassment, retaliation, wrongful termination, or wage theft, I bring strategic, informed, and tireless advocacy to every case.  I understand the power imbalance that exists between employers and employees, and I am committed to leveling the playing field.

I have personally seen the harm that results when workers are treated unfairly, and I strongly believe everyone deserves a workplace rooted in respect, equity, and accountability.  I am here to help you assert your rights—and win back what is owed to you.

Discrimination and Harassment

Disability, race, age, and gender-based discrimination and harassment are far too prevalent in the workplace. If you have experienced discrimination or harassment in any form, you have legal recourse.

Retaliation & Whistleblowing

Retaliation can take many forms. A sudden negative performance review, demotion, or termination, right after taking a medical, sick, or pregnancy leave can be textbook retaliation. If you're suddenly being treated differently after speaking up about a hostile work environment, that can be textbook retaliation. Fight back by contacting me to discuss your case.

PRACTICE AREAS

Wrongful Termination, Constructive Discharge, & Pretextual Lay-Offs

Being terminated unfairly or unjustly, being made to work with an abusive co-worker, or being laid-off for pretextual reasons (for example, because you are pregnant) can be grounds for a wrongful termination claim. Speak to me about the underlying facts of your termination to learn more.

Failure to Accommodate & Leave Law Interference

Too often employees are pressured into returning to work when they are on a protected leave, or  ignored by their employer when trying to take one. Don't let this happen to you. If you need a medical leave, or are already on one, you should be provided all the time you need to recover in accordance with applicable state and federal law.

Wage and Hour Compliance

California employers routinely fail to pay employees all of their legally owed wages. Whether that's underpaying your overtime pay rate, forcing employees to skip meal and rest breaks, withholding wages on termination, or misclassifying employees, contact us to understand what you are legally owed.

Employee Misclassification

Employers often misclassify workers as 'Exempt' to avoid paying overtime and meal and rest breaks. Don't let this happen to you. Contact me to discuss your classification status.

CONTINGENCY FEE

We work on a contingency fee basis, meaning our clients pay nothing unless we secure a settlement or win their case. Our attorney fees are then a percentage of the recovery, ensuring our clients directly benefit.
